Pre-Vetting Commission of Moldova remains without one member

Chisinau, 6 October /MOLDPRES/ - A member of the Pre-Vetting Commission, Vitalie Miron, on behalf of the opposition today informed that he had submitted an application on resignation.  

Miron noted that he was perplexed by the situation emerged, after the Supreme Court of Justice (CSJ) had admitted more appeals on behalf of more candidates who were not promoted by Commission and ordered the resumption of the procedure of their evaluation.   

“Thus, at this point, on the one hand, there is the factual situation of the candidates, materialized under decisions by the Pre-Vetting Commission on non-passage of the evaluation and on the other hand, under the CSJ rulings, the arguments of the Commission were disqualified and the latter is actually obliged to promote the candidates. Anyone who gets in the essence of the things would be aware of the fact that we are witnessing a legal absurd, when the taking of a decision would mean the infringement of the provisions of the Article 120 of Moldova’s Constitution through the non-fulfilment of CSJ rulings, which is an option not at all admissible for me,’’ Miron wrote on his page.  

“The legal mechanism failed to give the Commission possibility to assess all candidates objectively and under more aspects,’’ Vitalie Miron stressed.  

The Pre-Vetting Commission was set up on 4 April 2022, under the Law No 26 from 10 March 2022 on measures related to the selection of candidates for the positions of members in the bodies of self-administration of judges and prosecutors. The commission for the evaluation of the integrity of the future justice leaders is made up of six members, of whom three ones were appointed by the parliament, with the observance of the principle of proportionality between the majority and the opposition, proceeding from the number of mandates got. At the same time, the other members were put forward by development partners.
