New law on control of commerce with strategic goods published in Moldova's Official Journal

Chisinau, 29 August /MOLDPRES/ - The decree on the promulgation and the new law on the control of the commerce with strategic goods have been published in the Official Journal (Monitorul Oficial). The document will enter into force as of 1 January 2025.   

The new law regulates the criteria of exercising of the control over the trade with strategic goods; the delimitation of the competences of the public authorities in this sector; the regime of control and authorization of the commerce with strategic goods; the security of the information used in the control procedure; as well as the restrictions on the commerce with strategic goods.   

The document provides new definitions for the strategic goods, classified in three categories: products with double use, military products, products subjected to control nationally; services of intermediation, transshipment, cyber supervision products.   

Also, the document includes new activities related to the trade with strategic goods, such as: transshipment, services of intermediation, technical assistance and transshipment.   

Another provision of the draft regards the setting up of the national commission for control of the commerce with strategic goods. The composition, regulation of the activity of the commission and the list of strategic goods subjected to control will be approved by the government.

At the same time, the new law provides for possibility of the establishment of restrictions on the strategic commerce. The document envisages including the declaring of embargo to some countries, if they do not fulfill the obligations assumed before Moldova, as well as in the interest of the national security and of the foreign policy or under the decision of international organizations Moldova is member of.  

After the entrance into force of the new law, the Law on the control of the export, re-export, import and transition of strategic goods will be abrogated.
